Terms of Service

1. Acceptance of Terms

By accessing or using HerTelemeds.com (the "Site") or any services offered through it (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

These Terms constitute a binding agreement between you and Beauty Empower Group LLC, a Virginia limited liability company doing business as HerTelemeds ("HerTelemeds," "we," "us," or "our").

2. Description of Services

HerTelemeds is a direct-to-consumer telehealth platform that connects you with licensed healthcare providers for:

  • Asynchronous medical consultations specific to a requested treatment
  • Provider review of your medical intake information and photographs
  • Issuance of a prescription (when clinically appropriate and at the sole discretion of the provider)
  • Fulfillment of prescribed medications through a licensed partner pharmacy, or at your request, through a pharmacy of your choice

HerTelemeds is not itself a pharmacy, does not manufacture or dispense medications, and does not provide primary care services.

3. Eligibility

To use the Services, you must:

  • Be at least 18 years of age
  • Reside in a U.S. state where HerTelemeds and its prescribing providers are licensed and authorized to operate (current list of covered states is enforced at checkout; for inquiries email support@hertelemeds.com)
  • Have the legal capacity to enter into this agreement
  • Provide accurate, current, and complete information during the intake process

Services are not available to residents of any U.S. state not listed in our licensed-states list, to individuals outside the United States, or to minors. We may refuse service for any reason consistent with applicable law.

4. The Clinical Relationship

Scope of the relationship: Your interaction with a HerTelemeds provider establishes a limited professional medical relationship focused solely on the specific condition and treatment you are requesting. It does not replace a relationship with your primary care provider, and our providers do not act as your general physician.

Provider discretion: All prescription decisions are made by a licensed provider based on clinical judgment. The provider may decline to prescribe a treatment if they determine, based on your intake information, photographs, or medical history, that the treatment is not appropriate or safe for you. A declined prescription is not a denial of service and does not entitle you to challenge the clinical decision, though you are entitled to a full refund per our Refund Policy.

No emergency care: HerTelemeds does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room.

No controlled substances: HerTelemeds does not prescribe controlled substances of any kind.

5. Payment, Pricing, and Refunds

Price includes: For products fulfilled through our partner pharmacy, the price you pay at checkout includes the medication, shipping, and associated consultation. For prescriptions sent to a pharmacy of your choice (see Section 7), you pay only a reduced consultation fee; you are responsible for medication and dispensing charges from your chosen pharmacy.

Payment at checkout: You authorize HerTelemeds to charge the payment method you provide at checkout for the full amount displayed. All payments are processed through Stripe.

Refunds: If a provider declines to prescribe your requested treatment, you will receive a full refund within 5–10 business days. Other refund scenarios are governed by our Refund Policy.

Subscription or recurring charges: Where applicable to specific products, recurring charges will be clearly disclosed before checkout. You may cancel at any time through your account or by contacting support@hertelemeds.com.

6. Medical Intake and Photographs

You agree to provide accurate, truthful, and complete information in all medical intake questionnaires and any photographs you submit. Incomplete or inaccurate information may cause a provider to decline your prescription or to prescribe something that is unsafe for you. Intentional misrepresentation may result in termination of your account and forfeiture of any claim to services or refunds.

All medical information and photographs you provide are stored in our HIPAA-compliant electronic health records platform and are accessible only to our providers and authorized staff for clinical review.

7. Pharmacy Fulfillment and Your Right to Choose

By default, prescriptions issued through HerTelemeds are fulfilled by our licensed partner pharmacy, which ships medication directly to your verified shipping address.

Your right to choose a different pharmacy: You have the right, consistent with federal law and the laws of your state, to have your prescription sent to the licensed pharmacy of your choice (including any community pharmacy, mail-order pharmacy, or compounding pharmacy that accepts your prescription). To exercise this right:

  • Contact us at support@hertelemeds.com before your prescription is transmitted, or
  • Request the change during the checkout flow by selecting "Send to my own pharmacy"

If you choose to have your prescription sent to your own pharmacy, HerTelemeds will:

  • Charge you only the reduced consultation fee of $45
  • Transmit the prescription electronically to your specified pharmacy
  • Not handle any further dispensing or fulfillment

You are responsible for all charges from your chosen pharmacy. HerTelemeds has no relationship with any non-partner pharmacy and makes no representations about pricing, dispensing practices, or timelines.

8. Shipping

When fulfilled by our partner pharmacy, medications are shipped via USPS, UPS, or FedEx depending on the product and destination. Shipping is included in the purchase price. You are responsible for providing an accurate shipping address. HerTelemeds and its partner pharmacy are not responsible for delays or losses caused by incorrect addresses, carrier issues outside our control, or force majeure events.

Refrigerated compounded products are shipped with cold-chain packaging and require expedited carrier service (typically FedEx or UPS next-day or two-day). In the event your shipment is delayed to the point of compromising product integrity, contact support@hertelemeds.com and we will arrange a replacement.

9. No Resale; Personal Use Only

All medications prescribed through HerTelemeds are for your personal use. You may not resell, redistribute, transfer, or share prescriptions or dispensed medications with any other person. Doing so may constitute a violation of federal and state law.

10. Intellectual Property

All content on the Site — including text, graphics, logos, images, videos, and software — is owned by HerTelemeds or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or publicly display any Site content without our prior written consent.

11. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose
  • Impersonate any person or misrepresent your identity, age, or medical history
  • Attempt to gain unauthorized access to any part of the Services, other users' accounts, or our systems
  • Use the Services to obtain medication for someone other than yourself
  • Reverse engineer, scrape, or copy any part of the Site

12. Third-Party Services

HerTelemeds uses third-party service providers to operate portions of the Services, including:

  • Healthie (gethealthie.com) — electronic health records and clinical intake platform (HIPAA-compliant; BAA executed)
  • Amazon Web Services — infrastructure hosting (HIPAA-eligible; BAA executed)
  • Stripe (stripe.com) — payment processing (no Protected Health Information transmitted)
  • ShipStation (shipstation.com) — shipping label generation
  • Our partner pharmacy — licensed compounding and retail pharmacy operations

Your use of HerTelemeds is subject to the applicable terms and privacy practices of these third-party providers where they interact with your data.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • HerTelemeds, its officers, employees, contractors, and providers are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services.
  • Our total liability for any claim arising out of these Terms or the Services is limited to the amount you paid HerTelemeds in the twelve months preceding the claim, or $500, whichever is greater.
  • These limitations do not apply to liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded.

Clinical decisions: Providers are responsible for the clinical judgments they make. HerTelemeds does not second-guess or override provider clinical judgment. HerTelemeds is a technology and administrative platform; it is not a medical practice.

14. Indemnification

You agree to indemnify and hold harmless HerTelemeds, its officers, employees, contractors, and providers from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, your misrepresentation of medical information, or your unauthorized sharing or resale of medications.

15. Termination

We may terminate or suspend your account or access to the Services at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if we determine, in our sole discretion, that your continued use of the Services presents a safety or clinical risk. Upon termination, any refunds due to you per our Refund Policy will still be processed.

You may close your account at any time by contacting support@hertelemeds.com.

16. Disputes; Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association in Fairfax, Virginia, unless you opt out within 30 days of first using the Services by sending written notice to Beauty Empower Group LLC, 3060 Williams Drive, Suite 300, Fairfax, VA 22031. You waive any right to participate in a class action or class arbitration to the fullest extent permitted by law.

17. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on the Site with a new "Last Updated" date. Continued use of the Services after the effective date of the updated Terms constitutes acceptance. Material changes will be communicated by email to active users.
